This website is operated by BOOSTIVA. Throughout the site, the terms “we”, “us” and “our” refer to BOOSTIVA. BOOSTIVA offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

Effective Date: [03/01/2026]. These Terms and Conditions (“Terms”) govern all purchases of Boostiva products through the website. By creating an account or placing an order, you accept and agree to these Terms.

1. Eligibility and Account Responsibility. You must be at least 18 years old to purchase products. You agree to provide complete and accurate personal and payment information and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account.

2. Product Information and Availability. Boostiva strives to provide accurate product descriptions, images, and pricing. However, product availability and characteristics may change without notice. In the case of an obvious error (e.g., a misplaced decimal in the price), Boostiva may contact you to confirm or cancel the order.

3. Pricing, Taxes, and Shipping Charges. Prices are listed in U.S. dollars and do not include taxes or shipping, which will be calculated at checkout. Customers are responsible for any local duties, customs fees, or VAT/GST on international orders. Applicable taxes based on the delivery address will be added to the order. Boostiva reserves the right to update prices and shipping policies at any time, but changes will not affect orders already placed.

4. Dietary Supplement Disclaimer. Products sold are dietary supplements. Statements about health or benefits are made conservatively. “These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.” The information on this website is for educational purposes and is not medical advice. No medical advice. Always consult a healthcare professional before starting any supplement. Results may vary; individual experiences are not guaranteed. All marketing claims are made in compliance with FTC guidelines: claims must be truthful, non-misleading, and supported by reliable evidence.

5. Supplement Safety. Boostiva supplements are intended for healthy adults only. Do not use products if you are pregnant, nursing, or taking medications without consulting a doctor. If you have any adverse reaction, discontinue use immediately and seek medical advice.

6. Orders and Billing. After placing an order, you will receive an email confirmation. Title and risk of loss pass to you once the package leaves the U.S. fulfillment center. Boostiva is not responsible for shipping delays or damages caused by the carrier or customs processing.

7. Refund Policy. Opened or used supplements cannot be returned due to hygiene reasons. If a product is defective or incorrect, please contact Boostiva within 14 days of receipt for a replacement or refund at Boostiva’s discretion. Boostiva does not refund shipping or restocking fees. No refunds will be provided for international order fees (duties, taxes) or delays caused by customs or carriers.

8. Automatic Renewal Subscriptions. Boostiva offers a subscription program for recurring deliveries at a discounted rate. When you subscribe, you agree to automatic renewals under these terms:

  • Offer Description: The subscription will automatically renew at the frequency you select (e.g. monthly). You will be charged the discounted price shown at signup for each cycle, plus any shipping and applicable taxes.

  • Price and Billing: We clearly display the price per cycle and billing frequency before you join. Your first payment is due at checkout. Future payments will be charged automatically on the same calendar day of each period (e.g. monthly) unless you cancel. If you join during a promotional trial period, your card will not be charged until the trial ends, provided you have not canceled.

  • Clear Disclosure and Consent: All material terms of the subscription (product details, price, frequency, cancellation instructions) are presented clearly before you enroll. By clicking “Subscribe” or a similar button, you explicitly consent to the recurring charges and these Terms. We do not use pre-checked boxes; you must actively opt in.

  • Reminder Notices: For longer subscriptions (initial term over 6 months), Boostiva will send an email reminder 15–45 days before each renewal. This email will include the upcoming charge amount, date, and cancellation instructions.

  • Price Changes: Any increase in subscription price or changes to material terms will be communicated at least 5 to 30 days before the next billing date. You will have the option to cancel without penalty if you do not accept the changes, and any unused portion of a prepaid period will be refunded pro rata.

  • Payment Failures: If a payment fails, Boostiva will attempt to retry for up to 10 business days. If payment still fails, your subscription will be paused. You will receive an email notice and can update your payment method in your account to resume deliveries.

  • Cancellation: You can cancel your subscription at any time, online and without penalty, using the self-service cancellation portal. Cancellation is as easy as signing up. No phone calls or paperwork are required. After canceling, you will receive an email confirming the cancellation. Cancellation will stop future renewals; remaining prepaid shipments (if any) will still be shipped.

  • Refunds for Subscription: Except for defective products, subscription orders are non-refundable after shipment. If a price increase was charged without proper notice or consent, Boostiva will refund the difference for the unused portion of the term.

9. Shipping, Delivery, and Risk of Loss. We ship via reputable carriers. Boostiva is not responsible for carrier delays or lost packages. International customers should be aware of extended delivery times and local import regulations.

10. Warranty Disclaimer. EXCEPT AS EXPRESSLY STATED, PRODUCTS ARE PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTY, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Boostiva disclaims liability for damage or misuse of products. To the extent any warranty is implied by law, it is limited to the minimum period required by law.

11. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, BOOSTIVA’S LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF PRODUCTS OR THIS SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. Boostiva shall not be liable for any indirect, incidental, punitive, or consequential damages, even if advised of the possibility.

12. Indemnification. You agree to indemnify and hold Boostiva (and its officers, directors, employees) harmless from any claims, losses, or damages (including legal fees) arising out of your use of the products or violation of these Terms.

13. Chargebacks and Payment Disputes. If you dispute a charge, Boostiva may request documentation (order confirmation, tracking info, cancellation records) to resolve the issue. We will oppose illegitimate chargebacks and may limit service or terminate your account for fraud or abuse.

14. Governing Law and Jurisdiction. These Terms are governed by the laws of the State of New York, USA. Any dispute not subject to arbitration (see below) shall be heard exclusively in state or federal court in New York County (Manhattan) 

15. Arbitration Agreement. By accessing or using the Site or purchasing any products from Boostiva, you agree that any dispute, claim, or controversy arising out of or relating to these Terms, the use of the Site, or the purchase of any products shall be resolved exclusively through final and binding arbitration governed by the Federal Arbitration Act (FAA). The arbitration shall be administered by the American Arbitration Association (AAA) and conducted in accordance with the AAA Consumer Arbitration Rules, which are available at www.adr.org. Before initiating arbitration, the parties agree to attempt to resolve the dispute informally by providing written notice of the claim and allowing a 30-day period for informal resolution. Unless otherwise agreed by the parties, the arbitration shall be conducted by a single arbitrator appointed in accordance with the AAA Consumer Arbitration Rules. The arbitrator shall have the authority to grant any remedy that would be available in court under applicable law.

You and Boostiva agree to waive any right to a trial by jury or class action. Consumers with claims under the small-claims jurisdiction may choose small-claims court instead of arbitration. The arbitrator’s decision is binding, and the costs of arbitration are limited (Boostiva will pay any fees beyond the standard filing fee). You can opt out of arbitration within 30 days of purchase by sending written notice to Boostiva. See the full Arbitration clause at the end of these Terms (included within these Terms for compliance).

16. Global Reach and Local Consumer Rights. Although these Terms are governed by New York law, Boostiva serves international customers. For EU, UK, and other international orders, local mandatory consumer rights (such as EU consumer protection laws, right of withdrawal, etc.) are preserved where applicable. International orders may incur customs duties or VAT, which are the customer’s responsibility.

17. Miscellaneous. These Terms constitute the entire agreement. If any provision is found invalid, the rest remain in effect. Boostiva may assign its rights. Force majeure events (e.g. natural disasters, trade disruptions) excuse delays. We reserve the right to modify these Terms; changes will be effective on publication to the site and will apply to future orders only.
